The General Data Protection Regulation is a European Union law that was implemented on 25 May 2018 and requires organizations to safeguard personal data and uphold the privacy rights of anyone in EU territory. The regulation includes seven principles of data protection that must be implemented and eight privacy rights that must be facilitated. It also includes sanctions and fines.

Similar to GDPR, the South African POPI Act aims to encourage the protection of personal information that is processed by both public and private bodies. To do this, the Act introduces certain conditions that will establish the minimum requirements that businesses must comply with when processing personal information. The Act also provides rights to people when it comes to unsolicited electronic communications. The POPI commencement date is 1 July 2020 with a grace period of one year starting from the commencement date.
